SB15-260 Medical Marijuana Product Testing

Currently the retail marijuana code requires that retail marijuana be tested. The bill requires similar testing for medical marijuana. The bill states that testing will not begin until a marijuana laboratory testing reference library is created and licensees are set up for proficiency standards and tests. The bill creates a medical marijuana testing facility license.

Talking points:

  • Medical marijuana is medicine and should be tested for cannabinoid profile and contaminants.
  • By law, medical marijuana is for patients with debilitating medical conditions, conditions that could make them more vulnerable to molds, heavy metals and other potential contaminants in products from the medical marijuana industry.
  • Marijuana for medical use has been legal since 2001. Recreational marijuana has been legal since 2012. Although recreational products are subject to testing requirements, patients are still waiting to have their medicinal products tested.
  • Medical marijuana patients have a clear need, even a right, to know what’s in the products they’re purchasing from the industry.
  • Asking patients to bare the responsibility of testing industry products on their own is unreasonably cost-prohibitive and unreliable, especially when patients don’t have access to certified or licensed testing labs.
  • This bill doesn’t include a timeline. When can we expect mandatory testing to begin? How much longer will patients have to wait?
